An employment tribunal heard that James Eyles was "upset" that his time on the bottom had not been formally marked.

Mr Eyles defined he felt it was "demotion", and he was restricted to "menial duties", which was motivated by information of his disabilities.

"There is no such thing as a proof that the rationale he didn’t obtain a card or presentation was on account of his disabilities. His line managers have been off sick right now, so he couldn’t organise. In any occasion, it was discretionary for colleagues to rearrange this. For these causes, we conclude that this criticism of harassment associated to incapacity fails."
